Privacy Policy
I. Policy
Toronto Metropolitan University (the ”University”) supports the closely aligned principles of transparency and accountability and as such routinely provides public access to information about the University’s operations and decisions.
At the same time, the University is committed to protecting specific types of information, which, if disclosed, could reasonably be expected to result in harm to the University, an identifiable individual, or a third party. This subset of information includes personal information, teaching and research records, as well as law enforcement, solicitor-client, labour relations and other kinds of information which for the purposes of this policy will be referred to as “restricted information”.
As of June 10, 2006 the University became subject to FIPPA’s legal requirements concerning the use, disclosure, and retention of personal information, as well the obligation to provide access to University records with limited protection for certain kinds of restricted information. To enable the University to meet its statutory obligations under FIPPA, the General Counsel has developed a procedures document (“Procedures”) which identifies restricted information categories, employee responsibilities, and legislative highlights. This policy and the related Procedures do not limit the rights and obligations outlined in any existing relevant legislation.
University employees are responsible for reviewing and understanding this policy and the related procedures. General Counsel and the Information and Privacy Coordinator are responsible for disseminating the policy and Procedures to employees, making the policy and Procedures widely available, and developing the necessary tools and forms to support the Procedures.
This policy and the related Procedures shall be maintained and updated on an ongoing basis by the General Counsel.
II. Application and Scope
This policy extends to University employees and applies to all records in the custody or control of the University. If a provision of this policy conflicts with a statutory obligation, the conflicting provision of this policy will be inoperative to the extent of the conflict. This policy replaces the Freedom of Information Guidelines and the Protection of Personal Information Guidelines. III. Jurisdiction
The interpretation of this policy falls under the jurisdiction of the General Counsel.

By participating in Lincoln Alexander Law Professional Development offerings, and making use of content on the associated course catalog and learning management system (collectively the “Site”) you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before accessing or using any services, content, or materials provided by Lincoln Alexander Law Professional Development. If you do not agree to these Terms, you may not participate in Lincoln Alexander Law Professional Development activities.

Use
You shall not, without our prior written permission, use the Site for purposes other than your own personal, non-commercial use. Further, you may not frame the Site or any part thereof on any website without our prior written permission. You acquire absolutely no rights or licence to the Site other than the limited right to use the Site in accordance with the Terms. You shall not use the Site for any purpose except as expressly provided herein.
You may not:
• Reproduce, distribute, modify, publicly display, or create derivative works of the Materials without prior written consent.
• Share access credentials with others or allow unauthorized individuals to access Toronto Metropolitan University content.
• Use the Materials or services for any unlawful or prohibited purposes, including but not limited to attempting to disrupt or interfere with Toronto Metropolitan University operations.
Disclaimer
Your use of the Site is at your sole risk. The Site is provided “as is” and “as available”, and without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, non-infringement or third party rights and fitness for a particular purpose, and any warranties that access to the Site is uninterrupted or error-free, that the Site is secure or free of viruses or other harmful material, or that information on the Site is complete, accurate or timely.

The Site may contain links to third party websites. These links are provided solely as convenience to you. Toronto Metropolitan University is not responsible for the content of any third party website and does not endorse the information contained therein or guarantee its quality, accuracy, reliability, completeness, currency, timeliness, non-infringement, merchantability or fitness for any purpose.
Collection of Information
Toronto Metropolitan University only obtains specific personal information, such as your name, phone number or email address if you voluntarily complete an online form, submit an email to us with this information or register to use a portion of the Site. Should you choose to provide us with personal information, we will only use that information to respond to your request.
All personal information created, held or collected by Toronto Metropolitan University is protected under the Information Protection and Access Policy. At any point of collection, you will be asked for consent to collect your information or you will be advised of the authority for such collection. Toronto Metropolitan University will also inform you of the purpose for which the personal information is being collected, and how to exercise your right of access to, and correction of, that information.
Your personal information is not usually disclosed to anyone other than Toronto Metropolitan University staff who need the information to carry out their responsibilities. Any further disclosure of the personal information you give us would be in accordance with the Information Protection and Access Policy.
Note: Unless specifically noted otherwise, neither electronic systems nor email are secure information transmission methods. Therefore, we recommended that you do not send sensitive personal information electronically.
Code of Conduct
Participants are expected to conduct themselves professionally at all times. The following behaviors are prohibited:
• Making demeaning, offensive, or insulting comments.
• Using profanity or other inappropriate language.
• Engaging in intimidating or threatening behavior.
Toronto Metropolitan University reserves the right to terminate your access for any conduct deemed inappropriate or in violation of these Terms.
Cancellation and Refund Policy
Refund Eligibility
• Full Refund: A full refund is available up to three weeks before the program start date.
• Partial Refund: After the three-week period, a refund minus a $300 processing fee is available until the start date.
• No Refund: No refunds are available once the program has begun.
Attendee Substitutions
• Attendee substitutions can be accommodated. Please contact Toronto Metropolitan University administration for details.
Modifications to the Terms
Toronto Metropolitan University reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Toronto Metropolitan University website. Continued participation in Toronto Metropolitan University after such changes constitutes your acceptance of the new Terms.
Termination
Toronto Metropolitan University may terminate your access to its services or any part thereof at any time, with or without cause, and without notice. Upon termination, you must cease all use of the Materials and destroy any copies in your possession.
Indemnification
You shall defend, indemnify, and hold harmless Toronto Metropolitan University, its Board of Governors, officers, employees and agents from and against any claim or demand made by any third party, and all liabilities, damages, losses, costs and expenses (including but not limited to reasonable legal fees) arising out of or relating to your browsing or use of the Site, content that you transmit to the Site, or your breach of any of the Terms. Toronto Metropolitan University shall control the defence of any matter which is subject to indemnification by you and you shall co-operate as fully as reasonably required by Toronto Metropolitan University.
Limitation of Liability
Toronto Metropolitan University and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your participation in Toronto Metropolitan University activities, including but not limited to loss of data, profits, or opportunities. Toronto Metropolitan University services are provided on an "as is" basis without warranties of any kind, either express or implied.
Governing Law
Visitors can access the Site from all Canadian provinces and territories, as well as from other countries. The Terms of the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and these laws apply to the use of the Site, notwithstanding your domicile, residency or physical location. You hereby attorn to the exclusive jurisdiction of the courts of the Province of Ontario and all courts competent to hear appeals therefrom.
General
If any provision of the Terms is deemed invalid or unlawful, then the provision is deemed severed without affecting the validity or enforceability of any remaining provisions.
